Upcoming U.S. labelling requirements

Below is an important message from Agriculture and Agri-Food Canada:

The Market Access Secretariat at Agriculture and Agri-Food Canada would like to remind Canadian companies exporting to the U.S. that the first compliance date for the revised Nutrition Facts and Supplement Facts labels is on January 1, 2020, for manufacturers with US$10 million or more in annual food sales. Manufacturers with less than US$10 million in annual food sales will have until January 1, 2021, to comply. The compliance date for manufacturers of certain flavoured dried cranberries is July 1, 2020, while manufacturers of single-ingredient sugars such as honey and maple syrup, and certain cranberry products,  have until July 1, 2021. 

The U.S. Food and Drug Administration (FDA) has indicated that they will use enforcement discretion for the first six months after the new Nutrition Facts Label goes into effect on January 1, 2020, and will work with manufacturers to meet the requirements.

In addition, we would like to remind you that the implementation date of the U.S. National Bioengineered Food Disclosure Standard is January 1, 2020, but the USDA does provide a two-year transition period with a mandatory compliance date of January 1, 2022.  Under this rule, food manufacturers, importers and retailers who package and label food for retail or bulk food sales in the U.S. will be required to disclose information about GM food and GM food ingredients. Small food manufacturers with annual receipts of less than $2.5 million are , however, exempt.

Please keep these dates in mind when modifying your product labels destined for the U.S. market.  Regulated entities that are not immediately impacted by these regulations may voluntarily comply with the Nutrition Facts, Supplement Facts or Bioengineered Food Disclosure Standard  before the prescribed timelines.
